AMCP Statement on California vs. Texas Decision

Alexandria, Va., June 17, 2021 — Following the U.S. Supreme Court decision this morning in the case of California vs. Texas, AMCP released the below statement.   

Statement from Susan Cantrell, AMCP chief executive officer:  

"AMCP and our members are pleased the highest Court upheld the Affordable Care Act (ACA), protecting health care for millions of Americans. As the country emerges from a global health crisis, striking down the ACA could have negated pharmacy benefits and removed protections for the 135 million Americans who have pre-existing conditions — exposing them to  higher prices for coverage and making coverage unattainable for many. This ruling is a welcome win for millions, at a time when health coverage has never been more important.  

“AMCP works to ensure patients have access to the medications they need at costs they can afford. One way the ACA makes medication more accessible is by creating a regulatory pathway to approve biosimilars: FDA-approved versions of existing biologic medicines that are often used to treat complex, chronic conditions such as multiple sclerosis, rheumatoid arthritis, and cancer. Biosimilars, which are expected to deliver up to $100 billion in savings to the U.S. health care system in the next five years, are essential to millions of Americans across the country who live with chronic conditions. Striking down the ACA would have had immediate and costly ramifications for patients, the government, and payers – making many critical biologic therapies inaccessible.
